There are certain requirements regarding how service is done, and they must be adopted verbatim. If they are not, then the whole is invalid.

The server is a “process server.” Most times, this can be any person who is not a party to the case. Some folks pay professionals. Others have police officers like sheriffs or constable officers who do this. Point to remember: it must be done correctly.

Here are the key ways in which service occurs:

• Personal Service: You are personally given the papers by someone. This is the simplest process. And here is a point to note: even if you decline taking the papers, the service is nevertheless good as long as the process server was able to successfully leave them with you.
• Substitute Service: If they are unable to locate you, the server can hand the papers to another adult person who lives with you, or if it is a business, to a manager. They will often then mail the papers also.
• Certified or Registered Mail: The server sends the forms via the postal department or courier service such as FedEx or UPS. The key point: you (or yourself alone) must sign for it. No one can sign on your behalf.
• Acceptance of Service: You willingly accept the papers and sign a form that states you received them. This is proof that you received them, but not that you agree with what is stated in the complaint, and you can still represent yourself completely.
• Alternative Service: If a person is evading or cannot be located even with diligent effort, the court may permit service by notice on their door or by publishing them in a newspaper. In cases where individuals are actually avoiding service, skilled process servers can conduct stakeouts to ensure they are served.
• Then the server files with the court a document named “Proof of Service.” This is verification that everything was done right, it has the date, time, address, and manner that was used.
